President Obama Vetoes On Behalf Of Middle America

Fiduciary Rule:

A Department of Labor regulation prohibiting investment advisers from selling products with higher fees or lower returns just because they yield higher commissions.

Why would anyone in federal, state or local governance have issues with such a rule? If we consider US politics, the question becomes rhetorical. Which governing entity do you feel has issues with a fiduciary rule? (Rhetorical)

I recently sought out a few horror stories regarding investment advice/hype while contemplating the GOP’s strong resistance to efforts to protect investors from investment predators. A story on the Reddit  r/stocks web page, caught my interest. The story that appears to embody the essence of Department of Labor efforts to protect against financial investment vultures.(The parenthetic descriptor was a personal add to the comment.)

This story was explained to me by a senior broker where I work. 

An elderly couple bought into the hype on ICPT (Intercept Pharmaceuticals IncNASDAQ: ICPT) last year and decided to move all their money out of an IRA into a margin account so they could day trade. Neither of them had ever traded before, but they decided now was the time. As luck would have it, they started the day that ICPT crashed a huge amount, sometime in March 2014 I believe. They bought as much as they could as it kept falling, fully leveraging their account. After ICPT had already lost something like $50 they started selling, but it was too late. At the open, they had +70k, and at the close they were at -250k. This was their life savings, and they had just lost it all and then owed us more than triple what they started with.

The story may not totally embody guidance from financial investors, it certainly shows the extent to which following bad financial advice can ruin the financial health of citizens.  

While exploring a core value of the GOP, follow as we explore points embed in a “fiduciary rule” promulgated by the Obama Administration.

financial services industry advisers and managers must perform services for clients with a guiding focus as fiduciaries – effectively requiring advisers to  “solely in the interest” of clients – when giving advice regarding people’s retirement saving.

Are you wondering why such a “rule” would meet strong resistance from Republican members of Congress? Let’s look a bit closer.

Within a year of President Obama’s 2009 inauguration to the US Presidency, the Department of Labor (DOL) proposed a rule that would require financial advisers provide investment services in the best interest of their clients. The proposal was she

In 2010, the Department of Labor put forth a proposal to require retirement investment advisers serve in their client’s best interest. The DOL later withdrew the proposed rule in the in response to formidable GOP opposition.  In early 2015, DOL proposed a new “fiduciary” rule.


On April 20, 2015, DOL proposed a new rule to ensure that retirement savers would get their advice from fiduciaries. After a series of unsuccessful efforts to block the proposal by brokerage firms and a failed attempt to attach a rider to the end-of-year spending bill, the final rule was released on April 6, 2016.

If you re-read the last sentence from the MarketWatch excerpt, the genesis of GOP opposition to the rule comes as clear as the proper camera setting on a Nikon Series 5000 camera. GOP members of Congress (and certain blue dog Democrats) opposition to rules the protect consumers is a core value.  A value that drives GOP policy with legislative and validates the party’s service to monied interest and potential campaign contributors.

Last month, both House of congress voted in support of striking the fiduciary rule: the House by a party-line vote of 234-183 and the Senate 56-41, with three Democrats joining the Republicans. Republicans Senator Orin Hatch commented on GOP perception of the rule. white urging passage i the US Senate.  Note the corporatist tone of his comment. 

“Higher costs and a more burdensome system also means more expenses for small businesses trying to sponsor retirement plans for their employees,”

The shame of it all. Do everyday Americans stand ay chance of a productive life as long as the GOP has a group on Congress?

It is refreshing to know Democrats do to share GOP dedication to a better life for corporate  America at all costs.  President Obama recently vetoed the bill.

Veto Message from the President — – H.J. Res. 88

I am returning herewith without my approval H.J. Res. 88, a resolution that would nullify the Department of Labor’s final conflict of interest rule.  This rule is critical to protecting Americans’ hard-earned savings and preserving their retirement security.
The outdated regulations in place before this rulemaking did not ensure that financial advisers act in their clients’ best interests when giving retirement investment advice. Instead, some firms have incentivized advisers to steer clients into products that have higher fees and lower returns — costing America’s families an estimated $17 billion a year.
The Department of Labor’s final rule will ensure that American workers and retirees receive retirement advice that is in their best interest, better enabling them to protect and grow their savings.  The final rule reflects extensive feedback from industry, advocates, and Members of Congress, and has been streamlined to reduce the compliance burden and ensure continued access to advice, while maintaining an enforceable best interest standard that protects consumers.  It is essential that these critical protections go into effect.  Because this resolution seeks to block the progress represented by this rule and deny retirement savers investment advice in their best interest, I cannot support it.  I am therefore vetoing this resolution. 

Can anyone who read this piece recall a legislative measure advanced by the GOP which offers improvements to life for middle and lower income Americans?  Think hard and dispense the thought that would come forth as a lie.

Martin O’Malley, Milt Shook and Please Cut The Crap And "Black Lives"

“White Lives Matter.” Former Maryland Governor Martin O’Malley in response to black protests at an event in Phoenix, Arizona.  “… lives matter, white lives matter, every life matters.”
A noble and fair thought followed by a poignant statement? If police abuse of white and black Americans was administered equally, the statement is most apropos.  Equal abuse outside of the black community, is a bridge too far. O’Malley’s statement actually stands as comment from a person who is oblivious to the reality of cop abuse against Africa-Americans. Yet, the pseudo-progressive politician resorted to an insensitive phrase that hit my grey matter comparable to comment from Bill O’Reilly or Megyn Kelly of Fox News. All lives certainly matter, but all lives are not being taken by authorities paid to enforce our laws.

O’Malley’s misstep is a classic example of how pseudo-progressives harbor some of the same “cop abuse indifference” endemic in many white Americans.”  The reality is the reality of white privilege.

O’Malley has apologized for his choice of phraseology. As I stated above, I believe O’Malleys heart was in the right place, but his heart does not supersede the power of his brain regarding frank words that denote a core of indifference. We also shouldn’t overlook the reality of O’Malley appearing visibly angry about the protest interruption. While my perception of the protest lay in questioning the choice of protest venue, if we cannot find progressive politicians who also abhor “black abuse by cop”, black disinterest in the Democrat Party is our future. Republicans often criticize Democrats for using the black vote to win elections while  ignoring social issues that affect the black community.  

When O’Malley and other liberals/progressives ignore the horrors of “black abuse by cop” they run the risk drive the black vote away form the Democrat donkey.

We realize Fox News appeals to a segment of the US population that has little to no regard for humanity, the environment, the Obama Administration, progressives and liberals, and Fox News viewers seem to love the prospect of violence focused on the nation’s minorities. Fox viewers also tract right along with the GOP regarding a lack of regard for the nations poor and less privileged. So, what you are about to read does not surprise in any way. However, that does not mean Fox management decisions regarding their positions of current events isn’t report able.

All things considered, does it surprise Fox would drag two former New York City cops on-air to defend police military style mobilization of an American community? I am wondering if the wrong mobilization should be supplanted with the word “occupation.” Looting is an unacceptable set of behaviors. But, in the case of Ferguson, Missouri, we are seeing what appears like Soweto South Africa and black struggles against apartheid. It reminds of authority heavy handedness against peace protesters during the 1960s Viet Nam War protests.

On the other side of life in America and associated privilege conferred or denied(based in race), we did not see anything similar to the gassing and smoke bombing during Cliven Bundy’s tax evasion confrontation. I never once heard any law enforcement official, cop, nor federal government official refer to the militia and assassins in Nevada as “animals.” Nor, did I see one military style armored vehicle in Nevada. What could be different about the two cases of unrest? You might find that question rhetorical!

Think Progress reports on Fox News and the typical fox deployment of “whites only” panels to discussion issue regarding African-Americans. Of course, business give their customer what they want. I suspect any black people on certain Fox News panels would draw the ire of those who tune-in.

Bo Dietl, a Fox News contributor and former NYPD detective, went even further. He argued that authorities in Ferguson must “take charge” and defended arming local precincts with unused military equipment from the Afghanistan and Iraq wars by invoking the threat of global terrorism.

Sarah Palin: ‘It’s Time to Impeach’. Enough is enough of the years of abuse from this president. His unsecured border crisis is the last straw that makes the battered wife say, “no mas.” 

Without borders, there is no nation. Obama knows this. Opening our borders to a flood of illegal immigrants is deliberate. This is his fundamental transformation of America. It’s the only promise he has kept. Discrediting the price paid for America’s exceptionalism over our history, he’s given false hope and taxpayer’s change to millions of foreign nationals who want to sneak into our country illegally. Because of Obama’s purposeful dereliction of duty an untold number of illegal immigrants will kick off their shoes and come on in, competing against Americans for our jobs and limited public services. There is no end in sight as our president prioritizes parties over doing the job he was hired by voters to do. Securing our borders is obviously fundamental here; it goes without saying that it is his job.  

The federal government is trillions of dollars in debt; many cities are on the verge of insolvency; our overrun healthcare system, police forces, social services, schools, and our unsustainably generous welfare-state programs are stretched to the max. We average Americans know that. So why has this issue been allowed to be turned upside down with our “leader” creating such unsafe conditions while at the same time obstructing any economic recovery by creating more dependents than he allows producers? His friendly wealthy bipartisan elite, who want cheap foreign labor and can afford for themselves the best “border security” money can buy in their own exclusive communities, do not care that Obama tapped us out.   

Have faith that average American workers — native-born and wonderful legal immigrants of all races, backgrounds, and political parties — do care because we’re the ones getting screwed as we’re forced to follow all our government’s rules while others are not required to do so. Many now feel like strangers in their own land. It’s the American worker who is forced to deal with Obama’s latest crisis with our hard-earned tax dollars while middle class wages decrease, sustainable jobs get more scarce, and communities become unrecognizable and bankrupted due to Obama’s flood of illegal immigration.   

Who’s looking out for the American workers? Who has their backs? Who fights for them?   

We should.  

President Obama’s rewarding of lawlessness, including his own, is the foundational problem here. It’s not going to get better, and in fact irreparable harm can be done in this lame-duck term as he continues to make up his own laws as he goes along, and, mark my words, will next meddle in the U.S. Court System with appointments that will forever change the basic interpretation of our Constitution’s role in protecting our rights.   

It’s time to impeach; and on behalf of American workers and legal immigrants of all backgrounds, we should vehemently oppose any politician on the left or right who would hesitate in voting for articles of impeachment. 

The many impeachable offenses of Barack Obama can no longer be ignored. If after all this he’s not impeachable, then no one is.

Sean Hannity and Fox News trot-out the inimitable Palin for no other reason than to deliver of message to Hannity’s loyal followers. 

The response to the Hannity interview has been refreshing. 

I am reading many conservatives and members of the GOP would like Palin to “shut-up” via distancing themselves from her drivel.  As I hear and read such, I will admit to thinking in terms of GOP lip service vs meaning criticism. Also, the reports do not include comment about Fox News’s regular Palin bookings. If Fox Books Pain on Hannity;s show, there will be no relief. She will not shut-up if there is any prospect of a payday! Thus, the GOP is suffering like Dr. Frankenstein from a monster of its own creation. From the Left reaction to Palin’s impeachment comments are a muted reality. I find it intriguing the Obama Administration has given the go ahead for a top level official to answer questions about Palin’s nascent remarks. It is existentially shameful our national media is so influenced by a person who has proven a lack of cognitive acumen coupled with a tendency towards diarrhea of the mouth. The word “impeachment” broadcast across Fox News airways, obviously is a cause for concern and worth of addressing at the highest levels. President Obama has started to issue quips regarding impeachment mantra. Of much more significance, Attorney General Eric Holder addressed Palin’s exhortation to impeach while sitting for a very rare appearance on a Sunday morning news program. why of much more significance? Holder directly addressed the half-term Governor of Alaska and his perception of her lack of qualification and lack of competence to speak on the topic of impeachment.

An ugly episode that while the fault of money – grabbing operatives in Central America and failed Immigration Policy, is nonetheless, as ugly as it gets. This is how it looks. Murrieta California   Ugly, eh?

We have seen this before. While I am certain the mothers and chaperons on the Mureitta Homeland Security buses would have no knowledge of a time in 1961, history repeats itself. Of course, the conservative “USA, USA, USA” chant is a different animal than “Nigger Lover, Nigger Lover” there is a degree of connection. While the unsuspecting women from Central America have no idea of the real danger, rest assured the bus drivers and Homeland Security know the guttural possibilities of chanting and writhing mobs of whites and accompanying “differentiating: Latinos (the transformed and assimilated, “We are here, we have been here, and we are Americanized”. Those particular protesters remind of “differentiator” African-Americans and “differentiator Arabs. They align with whites who when the end comes will turn on them as surely as they are racially different. They are not white.  We have seen this before….. (1961)

As the Obama Administration weighs humane options for the humane treatment flocks of immigrants from Central America, consideration of temporary housing vs virtual prison internment is a problem. The 50,000 borders crashers are living in a manner no one should find acceptable.   
While thinking of the after life of people who have literally traveled the most precarious and dangerous journey imaginable, my mind fails to recall comparable journeys. A close second could be the harrowing journey of Cuban refugees who, for years, signed-on as boat people on insanely overcrowded rickety boats for touch the shore sprints to Florida. The women, children and infants from Central America also suffer a dangerous journey for opportunity to literally save lives and avoid forms of psychical abuse. Cuban refugees (As they were called) journey for a better life; the Central American “Illegal Immigrants/aliens”, as they are being called, wish to escape a far greater horror.

When we stand these despicable people up against the Cliven Bundy Klan (excuse the pun), I agree it was and awesome moment. A moment of disgust, race based nationalism, and disparate treatment. I do not for one second believe these same ‘ugly” Americans would react similarly to buses of immigrants from Canada.

Of, course the mob practiced free speech. It has become increasingly popular for “Red blooded/Apple Pie” Americans to use the most vile language and run to the sanctity of the US Constitution. Their child-like sanctity is nothing compared to those who co-sign their abuse as a form of paradigm validation via “Freedom of Speech.” The moment someone with an opposite social/political point of view speaks out, a counter response from Fox News is a guaranteed program item. A counter response that becomes the conservative talking-point of the week.
MSNBC reported the Mayor of Murrieta may have actually incited the protesters to act.  

Activist groups have responded to the “USA, USA, USA” chanting crowd with “breathe of free air” counter comment.  

“What I saw was one of the worst things I’ve ever see in my life … we saw the worst of the American spirit,” Enrique Morones, executive director of the San Diego non-profit Border Angels, said during a rally in San Diego. “These are migrants that are escaping a very violent situation in Central America, they simply want to live, and that’s how they’re greeted?”

Observation! I do not recall such behavior (hatred and flag wing “USA, USA, USA” chants as our nation welcomed thousands fleeing genocide and violence in Eastern Europe. Wonder why? 
I will end the piece with a short piece from NBC News. Empathy for both sides of the migrant issue is warranted. The ugliness of the flag laden, stripped hat wearing USA chanters is as despicable as images posted above. Now, take the protest to another level with the prospect of a gun toting quack-job hiding on a bypass firing a weapon at the buses.

Immigration “blame” accepted with a caveat. Why blame Obama and the Congress when, like many other issues.  GOP congressionals have stymied immigration reform. If you think my assertions (Both direct and implied) regarding race and some in the white community are far-fetched, two things apply. First, you have never read a piece on this site before. Moreover, you may need a bit more convincing based on your reluctance to face an American reality.

QZ Dot Com is reporting favorable June 2014 economic data with indications of an improving economy. News that has to set a flame under America’s conservatives, especially the RNC, GOP and its election operatives. We can anticipate heightened levels of “scandal chasing ” from the GOP through the month of July. The most effective way to drown-out good economic news is to scream “scandal, scandal, scandal” while following The Drudge Report and Fox News leadership. The GOP, RNC and GOP congressionals follow their leaders as well as any fabled Pied Piper.

Manufacturing employment

The ISM gauge of factory employment stayed above 50, the line that separates expansion from contraction. That indicates ongoing job growth in the cyclical industrial sector, which is watched as proxy for the broader economy.

Private sector surge

The payroll-processing company ADP’s monthly report on private sector job creation showed the strongest pace of new employment seen since November 2012.

Online job ads

The private research group known as the Conference Board has seen a fresh surge in its tally of new online job advertisements, a good sign of increased labor demand.

The US economy added 281,000 Private sector jobs last month. The increase in private sector payroll additions was the largest increase since November 2012 exceeding the May jobs report by 102,000 jobs and exceeding economist’s forecasts by 81,000 jobs.

It doesn’t take an economist to see the harsh winter of 2013/13 slowed job growth with a marked decreased in growth in January of this year.

Yahoo News published an early morning report in anticipation of the Dow breaking the 17,000 mark for the first time in Dow Jones Industrial Average (DIJA) history. While the Dow closed 24 points shy of 17,000, the Yahoo report was a welcome (with morning over coffee report.)

The Dow Jones Industrial is setting the stage to hit the milestone 17,000 mark in Wednesday’s trading. Data from employment to housing is fueling confidence the U.S. economy is rebounding. This morning’s ADP report showed private-sector hiring increased in June. The ADP report is out ahead of the June jobs report which will be released by the labor department on Thursday because of the shortened holiday trading week Shares of JPMorgan (JPM) will be watched closely today after the bank’s CEO Jamie Dimon disclosed he has a curable throat cancer and will begin an 8-week treatment plan. The most powerful women in global finance, Fed Chair Janet Yellen and IMF Managing Director Christine Lagarde take the stage together for the first time today. TheStreet’s Susannah Lee has the details. 

The DIJA will break 17,000 this week, even briefly before falling back below the historic mark. As the week progresses we can also anticipate major fronts from the Right to cover the economic news like hiding a pile of dirt under the nearest rug as guests ring your door bell.

While we do not yet have a report regarding the June unemployment rate, we can rest assured the RNC, GOP and Republicans in congress are in deep discussion of a “Poo-Poo” response to cover an unemployment rate that could draw near 6.0% vs the current 6.3 percent.  It is safe to assume the rate will not drop enough to break the 6.0% level, yet the thought of a major GOP butt-pucker at 5.9% would surely register on the Richter Scale.

Let’s get one thing straight. Cliven Bundy owes the US government over $1,000,000 USD for grazing fees in violation of the Taylor Grazing Act. It is important to again state, other western ranchers are complying with the grazing act.

They next critical point of discussion: Bundy is a tax evader! Moreover, he has publicly stated he does not recognize the US government, all the wile traipsing around like a half-crazed fool brandishing the US Flag. Therein lies a form of sedition, if you factor-in other actions by Bundy and his zany anarcho-terrorists militia supporters, and hordes of whacked out non militia supporters.

Of course, we should not forget early and ongoing (for a period) 24/7 Bundy support from Fox News. Coverage that included swan Hannity as the leader of the Fox News pack. Fox became an active media outlet for anarcho-terrorist sedition.

While unrelated to the key focus of this screed, I would be seriously remiss if  I did not also mention Bundy and his, “….let me tell you what I know about the Negro.”  Regardless of how you regard his comments, it is impossible to avoid consideration of the remarks as that of words from a racist.

Now, let’s move top Bundy’s anti-US army.

On May 6th and before the May 6th appearance e on the Ed Show MSNBC has broadcast Nevada congressman Steven Horsford’s appeals for a return to normality in his district. Horsford reported on multiple MSNBC and CNN segments about anarcho-terrorist forcing local residents to produce forms of ID and the congressman reports Bundy’s army has entered local schools. We can only surmise Fox News has no concern about innocent residents who are now victim of Bundy’s army.
Should the self-declared rights of an avowed tax evader superseded he rights of local citizens, and our rights are compliant tax payers? The answer is obviously, “No.” And, it should not surprise  anyone the Justice Department would dispatch an investigation team to investigate people pointing rifles at law enforcement officials?   The poli/social Right levels incessant references to the Obama Administration as “weak,” regarding Obama’s lack of interest in pursuing war on an international basis. Yet, we hear nothing from the usual suspect right-wing demagogues regarding, Justice Department dealing with implied threats to fire-on federal officers from the Bureau Of Land Management (BLM) and local Las Vegas law enforcement.

LAS VEGAS — The 8 News NOW I-Team has learned that FBI agents have started an investigation into the events surrounding a potentially deadly showdown one month ago surrounding rancher Cliven Bundy. 

It is one thing for Cliven Bundy and his supporters to square off against an assortment of Bureau of Land Management employees. It is quite another when the FBI enters the picture, and that is exactly what has happened. 

The I-Team has confirmed that FBI agents have launched a formal investigation into alleged death threats, intimidation and possible weapons violations that culminated with a dangerous showdown on April 12, and the first people to be interviewed by FBI agents are Metro Police, starting with Clark County Sheriff Doug Gillispie. 

Federal employees suspended their roundup of Cliven Bundy’s cattle, following a confrontation outside the BLM compound near Bunkerville. At the urging of Metro Police, Bundy’s cattle were released, but BLM’s new director announced the matter wasn’t over and would be resolved, one way or another.

While the vast majority of readers who visit the TPI, follow the rational thought Bundy should be held accountable for grazing on public land and responsible for paying associated taxes, I am certain some who do not agree will run across this piece. After the reader enacts cognitive processes that lead to support for Bundy and his anarcho-terrorist, I offer this set of images and the source linked article.

Perspective on the Public Response 
Ultimately, the important issue in this story is not the grazing dispute, in and of itself, but rather the response by activists and extremists who want to turn the Bundy Ranch into a cause, if not a hill to be martyred upon. 
Once it became known that the federal government was attempting to impound Cliven Bundy’s cattle, hundreds of armed supporters came to “support” his cause, some from many miles away. Most of these people have absolutely nothing to do with ranching and are simply latching onto the Bundy ranch as a justification to express their preexisting hatred for the federal government. These activists are part of a persistent fringe of anti-government extremists who have regularly committed violence on our soil (ex. Timothy McVeigh) and targeted federal agents for the terrible offense of being public servants rather than “rugged individualists” (who, ironically, mooch off of the system while refusing to pay taxes). 
Put simply, the fact that extremists with guns got the Bureau of Land Management to back off in this case is a breakdown of the rule of law and a terrible precedent.


Because Bundy and his cohort are white conservatives—a group that many in power are terrified of offending—the media have truly failed to recognize just how dangerous this precedent is; in order to fix this oversight, we need only translate this situation into analogs involving other groups and imagine the reactions from the public and authorities:
  • A black family decides to take over a public street, without permission and refusing to pay any fees, and use it to host a public gathering for a few weeks; when the police arrive to ensure that this family doesn’t illegally monopolize a public resource, a bunch of other African Americans show up with guns and threaten a shootout if the family is kicked off of the street.


  • The owners of a mosque decide to build an extension of their building into the parking lot for a federal building without permission. When the federal government tries to stop the mosque from building onto its land without permission, a group of devout Muslims gather with assault rifles to threaten violence against any federal agent who tries to stop construction.


These two hypotheticals present similar situations to the Bundy fiasco—where a group of Americans decide to illegally use public goods and, when called out, are supported by an armed group of people from a similar demographic—yet it is obvious that both would be portrayed dramatically differently. The black family would be seen as “thugs” and criminals who take public resources and threaten violence when called out on it. In all likelihood, this family would be the arrested and charged, if not shot dozens of times by an overzealous police force. The Mosque owners would be seen as terrorists and would likely be shot or detained as such (I can almost hear the drone motors revving up from here).

Battle of the Year: Hayes Vs Stefano; Who Got Schooled?

Early in the week, the Obama Administration announced an extension for Americans who are in the midst of the ACA enrollment process via an extension to April 15, 2014 (Vs the actual March 31, 2014 deadline).

The deadline extension was reported for people who for whatever reason are immersed in enrolling for the ACA. I have read the deadline change would predominately benefit people who had attempted to enroll in the ACA and may have a record of their efforts. It was reported as not an open extension for all. I frankly suspect however, some will take advantage of the deadline change and start the process. But, I ask, how should the Administration handle people who for various potential reasons failed to compete the sign-up process by this coming Monday?  

Needless to say, right-wing media, conservatives and all who work for the vast Koch brothers network are seething about the deadline extension. Chris Hayes MSNBC, ALL IN, found out the level and scope of angst and ugliness as he invited a regional director from the Koch brothers Americans For Prosperity to sit in discussion.  Discussion did not ensue. 

Hayes sat with Jennifer Stefano and another guest (for the latter portion of the interview).  

Ms. Stefano joined Hayes and seemed to be primed for a classic conservative go-off.  She never answered the question related to why angst from the two week extension, she also failed to discuss any references to GOP refusal to enact Medicaid Expansion.  Since we know MSNBC provides on-air topics to guest (or some form of brief) , we know Stefano was not surprised with Hayes’s questions. The real issue is, why not answer the questions. If she could not provide an answer her employers would find palatable, why not opt out of the interview? Yet, Stefano opted for a sports analogy we have all heard,“…a good offense if the best defense.” 

Since I used a sports analogy above, allow me to say the following is the rightful domain and key responsibility of the show host. The host role: ask the initial question and monitor the segment for accomplishing the focus of the segment. So, let’s say Hayes fired-off the opening and initial “offense” and possibly placing the guest in a defensive posture. It is a basic dynamic of “challenge” TV reporting or questioning when the guest is known to hold opposing views. Unlike many Fox News host/guest interactions resulting from carefully chosen and strategically placed (validating) conservative guest.

According to Yahoo News (and co-signed by Yahoo News), after the initial question Hayes interrupted Stefano several times. (The piece also includes a bit of fact-checking)

The Independent Journal Review and other conservative sites argued that Hayes got “schooled,” and destroyed,” and noted — accurately! — that Hayes interrupted Stefano several times.

After 25 seconds of Stefano never once addressing the question, while issuing a diatribe about being a mother and her children, Hayes performed the first attempt to provide structure to his question and move his show forward. Stefano and Hayes both know the clock is not an ally of the host if the guest can “Gish Gallop” through pre-programmed minutes.

Over the course of the interview, Stefano actually knocked herself “out.”  The issue of “schooling” is a politically correct way of imparting the ridiculousness of Stefano’s performance and efforts to spew Koch brothers/Rovian talking points. Their was no schooling as Stefano’s misson was to appear and spew Koch talking points. She responded to Hayes’s effort to re-direct to the initial question with her next bag-of-tricks talking-point, “the president lied!” 

From that point Stefano’s performance rivaled some segments of the old Jerry Springer show replete with head-bobbing, finger pointing and Stefano’s wide open oral cavity emanating various forms of “You don’t know me” or “How dare you.”  

The day after the (figurative) “bout”, I posited, “Yes, Stefano we now know you and we know for whom you and we are not surprised.”  

We wonder if Bill O’Reilly took offense to your deploying one of his patented “go-offs.”  Another area of wonderment is why Stefano decided to deploy a “Gish Gallop” (a weak and out of bounds) debate technique.  Since, we know guest on MSNBC are given a heads-up and possibly given briefs on the topics from the show host, we know that Stefano knew exactly what Hayes would ask. Why did she choose to completely avoid answering questions with a preference for attempting a strategy best called: ” the best defense is an offense?” 
Stefano without personal shame avoided Hayes’s questions by providing feed for Breitbart News, The Daily Caller, Fox News and other LIV (Low Information Voters) high-emotion conservative media.  Actually, her ill-fated performance was a live exhibition of what we see in AFP (Koch brothers) television advertisements without the Springer show yelling.  Instead of airing real cases of people who have suffered under the provisions of the ACA, the Kochs and their ad agency professionals broadcast actors speaking from scripts or people speaking half-truths about their (alleged) predicament.

Yahoo News structured their screed around “who got schooled.” Let’s listen to Stefano roll-through a series of points she calls facts. Points that are not being supported as “facts.” Hayes attempts to (rightfully redirect). Why should The Independent Journal Review and Yahoo News expect Hayes to sit back and facilitate a Sean Hannity-like talking- point barrage when the guest was not answering questions about the recent extension?

At this point in the interview Stefano continues railing like a Jerry Springer prime seat guest, while Hayes attempted to redirect to an answer. Notice Stefano moved to the beginning of a “… don’t know me….”  go-off.  At one point, Hayes actually showed a bit of frustration via a clear eye-roll in response to a Stefano point and her increasing Bill O’Reilly like behavior. After a few more seconds of talking-points based on seemingly inaccurate information (I will not suggest she lied), Hayes managed to fulfill his role as facilitator via as follows.

Now, as Hayes and his guest move towards the end of their time together, notice the seeming pre-planned “offense is the best defense” from a guest who did not answer the question that precipitated her show booking. 

Here we go…. Have you noticed this look on O’Reilly as discussion draws on an inner core of lack of confidence that when cornered generally manifest in anger?

Notice the Ugly and an effort to end the segment with….“You are a good guy otherwise.”  A bit judgmental from a person who just finished showing the deepest level of anger, uncivilized on-air behavior and gauche. Some would say . she showed her ass.” A dynamic loved by Fox News viewers, but held in contempt and disdain by people who tune to current event of news related shows. How about the non-prospect that Hayes had responded, “..well you certainly have not shown signs of being a nice person?”

If there was anything worthwhile from the interview other than a lesson in being prepared for GOP “Gush Gallop,” it could be an opportunity for fact-checking. And, fact checking is taking place. We will report on  claims from Stefano as we find them across the web or on MSNBC. 

Fact-checks from Fox News and CNN will probably not take place for obvious reason. Fox News has no interest in ACA data veracity Vs emotional rants, and CNN is 24/7 occupied with ratings garnering coverage of the Malaysian MH370 tragedy. We should add CNN is doing a good job of covering the recent mountain slide in Washington State.

As we consider Stefano and her conservative performance, we have to suspect her appearance was not only approved by the Kochs, we can assume she would only speak from the confines and pre-approval of a playbook.  Do you think for one second Karl Rove and other operative were not are of her appearance well before she sat to ‘explode?’ It does not happen in the lock-step GOP and RNC.

What a flippin dumbass, elitist! The saddest part of it all. This guy would join the chorus of people who railed against President Obama’s comments about, people “not building that by themselves.”  The interaction took place last summer. 

We post the Upworthy piece, because of the extent to which people will sap the good of government programs, and in may cases, look back at others who truly need assistance and scornfully complain or indict.

What’s The Dumbest Thing You Could Say To A Congresswoman Who Lost Her Legs In Battle? Um, THIS.

An IRS contractor named Braulio Castillo hurt his foot playing football in military prep school. He never served in the actual military. Then one day, decades later, he used it to get preferred treatment in government contracts. Rep. Tammy Duckworth (D-Ill.), who lost both her legs and still could lose her arm from combat injuries, felt that this might just be a touch inappropriate. It gets amazing around 4:30.

This is especially egregious in light of the fact that it takes most vets an unnacceptably long time to get the help they need for basic services, let alone government contracts. My friend, who is a vet, informed me that many vets don’t feel like they can apply at all because their injuries were so mild compared to injuries vets like Rep. Duckworth had. (Said vets have very valid injuries, like PTSD, shrapnel, and brain trauma, etc.) So the world needs to know about guys like this to prevent them from getting away with fraud. I’d love it if you shared and tweeted this. My friends who actually sacrificed in the line of duty would really appreciate it, too.

Delores Duckworth: Thank you, Mr. Chairman. You know this hearing is very troubling to me because this case really shows how things can go wrong. I want to support our small business owners as much as possible. I want these set asides to be successful. But I am absolutely appalled by the advantages that have been taken of the system.
Mr. Flohr, I know you cannot discuss Mr. Castillo’s case because you would need his permission to discuss his particular case. That’s why you could not answer the question earlier. My understanding also is that the VA, VBA specifically, is bound by legislation that says a certain condition has a certain disability rating. For example, a below-the-knee amputation is 40%.
It just is. Correct?
Mr. Flohr: That is correct, ma’am.
Delores Duckworth: So it seems like there is an opportunity here for some legislative fixes to the system. Mr. Chodos, is it true that any rating, even if it’s just 5%, would qualify someone for a service connected disability owns business?
Mr. Chodos: So long as they qualify under the VA’s rules for service connected disability. That is adequate for the self-certification.
Delores Duckworth: Thank you. Mr. Castillo, how are you? Thank you, for being here today.
Mr. Castillo: I am not well, but you’re welcome.
Delores Duckworth: All right. So your foot hurt? Your left foot?
Mr. Castillo: Yes, ma’am.
Delores Duckworth: It hurts. Yeah, my feet hurt too. In fact, the balls of my feet burn continuously, and I feel like there is a nail being hammered into my right heal right now. So I can understand pain and suffering and how service connection can actually cause long-term, unremitting, unyielding, unstoppable pain. So I’m sorry that twisting your ankle in high school has now come back to hurt you in such a painful way, if also opportune for you to gain this status for your business as you are trying to compete for contracts.
I also understand why something can take years to manifest themselves from when you hurt them. I have a dear, dear friend who sprayed Agent Orange out of his Huey in Vietnam who it took 40 years, 40 years for the leukemia to actually manifest itself, and he died 6 months later. So I can see how military service, while at the time you seem very healthy, could 40 years later result in devastating injury.
Can you tell me if you hurt your left foot again during your football career, subsequently to twisting it in high school?
Mr. Castillo: Ma’am, I don’t understand the high school . . .
Mr. Flohr: [Generally] prep school.
Mr. Castillo: I apologize.
Mr. Flohr: Post high school.
Delores Duckworth: Post high school. OK. Prep school, before college. Prep school. Did you injure your left foot again after prep school?
Mr. Castillo: I’m not sure I understand the question, ma’am.
Delores Duckworth: You played football in college. Correct?
Mr. Castillo: Yes, ma’am.
Delores Duckworth: As a quarterback?
Mr. Castillo: Yes, ma’am.
Delores Duckworth: Did you hurt, did you injure that same foot again, subsequently in the year since you twisted it in prep school?
Mr. Castillo: Not to my recollection, ma’am.
Delores Duckworth: Not to your recollection. OK. Why didn’t you, Mr. Castillo, tell the VA that your doctor’s note to them was inaccurate when you knew that it was?
Mr. Castillo: I don’t feel that it’s inaccurate, ma’am.
Delores Duckworth: OK.
Mr. Castillo: Would you like me to address that?
Delores Duckworth: Yeah. Go ahead.
Mr. Castillo: Yes, ma’am. So one of my doctors submitted the letter. So, as part of the injury, you have to establish that it is chronic and reoccurring. So when I returned home to San Diego, my doctor from San Diego had also, had said that he had treated me for the foot injury that I suffered on active duty. When I moved to Las Vegas, a couple years later, that doctor submitted that he continued to treat me for that left foot, broken foot injury. Finally, when I moved to Virginia, I went to a doctor, and it continued to hurt. And he established that, so Dr. Sam Wilson, who ironically was also stationed at Monmouth . . .
Delores Duckworth: OK. I have to cut you off because I am running out of time.
Mr. Castillo: OK.
Delores Duckworth: I’m sorry.
Mr. Castillo: So I just want to, just, so let me finish. So in talking to Dr. Wilson, who himself is a disabled veteran and very familiar with Monmouth in that his son had went through it himself as well and played football. He actually was the one that talked to me about . . .
Delores Duckworth: OK.
Mr. Castillo:. . . “Hey, this may be something that is connected.”
And I believe I told him . . .
Delores Duckworth: So let me, let me . . .
Mr. Castillo:. . . that I was first hurt . . .
Delores Duckworth: I have to cut you off. I have to cut you off.
Mr. Castillo: OK.
Delores Duckworth: This is not an argument. I’m talking.
Mr. Castillo: Yes, ma’am.
Delores Duckworth: I’m up here.
Mr. Castillo: Yes, ma’am.
Delores Duckworth: Let me ask you this. Do you feel that the 30%
rating that you have for the scars and the pain in your foot is accurate to the sacrifices that you’ve made for this nation?
Mr. Castillo: What . . .
Delores Duckworth: That the VA Decision is accurate in your case?
Mr. Castillo: Yes, ma’am, I do.
Delores Duckworth: You know, my right arm was essentially blown off and reattached. I spent a year in limb salvage with over a dozen surgeries over that time period. And in fact we thought we would lose my arm, and I’m still in danger of possibly losing my arm. I can’t feel it. I can’t feel my three fingers. My disability rating for that arm is 20%.
In your letter to a government official, I think it’s the VBA, Attention
[Gina Mu], you said: “My family and I have made considerable sacrifices for our country. My service connected disability status should serve as a testimony to that end. I can’t play with my kids because I can’t walk without pain. I talk twice daily pain medication so I can work a normal day’s worth. These are crosses, these are crosses that I bear due to my service to our great country, and I would do it again to protect this great country.”
I’m so glad that you would be willing to play football in prep school again to protect this great country. Shame on you Mr. Castillo. Shame on you. You may not have broken any laws. We’re not sure yet. You did misrepresent to the VBA, but you certainly broke the trust of this great nation. You broke the trust of veterans. Iraq and Afghanistan veterans right now are waiting an average of 237 days for an initial disability rating, and it is because people like you, who are gaming the system, are adding to that backlog so that young men and women, who are suffering from post-traumatic stress, who are missing limbs, cannot get the compensation and the help that they need. And I’m sure you played through the pain of that foot all through college.
Well let me tell you something. I recovered with a young man, a navy corps man, who while he was running into an ambush, where his Marines were hurt, had his leg knocked off with an RPG. He put a tourniquet on himself and crawled forward. He is who played through the pain, Mr. Castillo. You did not. You took advantage of a system. You describe the status, just today, that other companies were using these special statuses as competitive weapons against you. You, who never picked up a weapon in defense of this great nation, very cynically took advantage of the system. You broke the faith with this nation. You broke the faith with the men and women who lie in hospitals right now at Walter Reed, in Bethesda, at Brooke Army Medical Center in Longview. You broke the faith with them. And if this nation stops funding veteran’s health care and stops and calls into question why veterans deserve their benefits, it is because cases like you have poisoned the public’s opinion on these programs.
I hope that you think twice about the example that you’re setting for your children. I hope that you think twice about what you are doing to this nation’s veterans who are willing to die to protect this nation. Twisting your ankle in prep school is not defending or serving this nation, Mr. Castillo.
Mr. Chairman, I’m sorry. You have been very indulgent. I yield.

I was denied opportunity to enroll in promised “life-time” medial care via the Veterans Administration due to George W. Bush and Dick Cheney’s 2003 edict that included earnings requirements. while the Obama Administration raised the earnings restrictions with consideration of earnings and family size, the net-worth provision still stands. Some of us who have worked hard throughout our lives and set aside a bit of a nest-egg, still feel abandoned as the promise of life-time medical coverage factored as integral to our savings strategy.
